Kitzmiller Case

在 Kansas State Board of Education 10月份的最终投票表决之前，另一场智慧设计论（Intelligent Design）与达尔文进化论的冲突已经提前上演。

9月26日，以 Tammy J. Kitzmiller 为首的11名家长和 Dover Area School District（DASD）、Dover School Board 之间的诉讼进入宾夕法尼亚州中区地方法庭（U.S. District Court for the Middle District of Pennsylvania）的法官审（Bench Trial）阶段。这场诉讼的焦点是，Dover 地区的学校是否应将智慧设计论引入科学教育课堂、使用持有智慧设计论观点的《Of Pandas and People: The Central Question of Biological Origins》作为学习生物起源理论的教材之一。

原告在8月8日提交了一份 Opposition to Defendants’ Motion for Summary Judgment，其中认为 DASD 的做法与 Lemon Test 第1、2点相违背的观点成为法庭在9月13日驳回被告的提前判决动议（motion for summary judgement）的主要依据：

“the Policy is violative of the first two prongs of the Lemon test, the purpose and effects prongs.”

“Either an improper purpose or an improper effect renders the Policy invalid under the Establishment Clause.”

“we hold that genuine issues of material fact exist regarding whether the challenged Policy has a secular purpose and whether the Policy’s principal or primary effect advances or inhibits religion, despite Defendants’ arguments to the contrary. Accordingly, summary judgment is not warranted and Defendants’ Motion shall be denied. ”

于是双方的诉讼大战从26日正式打响。

如果此事闹得足够大，应该是比 Kansas State Board of Education 的投票影响更为深远的事件，所以关心达尔文进化论、智慧设计论、基督教等等的人不妨继续密切关注此事的进一步发展。
